Summary Judgment Granted in Living Mesothelioma Case

Brad Bleichner and Karen Goldberg teamed up to once again claim victory in an asbestos related case filed in the Los Angeles Superior Court. Selman Breitman LLP represented defendant Aurora Pump in this living mesothelioma action. Plaintiff claimed exposure to asbestos while working as a pipefitter during his career spanning more than 40 years. Specifically as to Aurora, plaintiff claimed he was exposed to asbestos-containing pumps manufactured, supplied and/or distributed by Aurora at his various jobsites. Aurora moved for summary judgment on the basis that plaintiffs could not present any admissible evidence to establish the essential element of causation. At the hearing, Mr. Bleichner and Ms. Goldberg argued, and the court agreed, that there was no triable issue as to whether or not plaintiff worked on or around an Aurora pump, let alone one that contained asbestos. Thus, summary judgment was granted and entered on behalf of Aurora.
